Description of the Horizontal Initiative (including funding agreement):

To respond to the recent growth in the number of major resource projects and move forward on commitments to create a more accountable, predictable and timely regulatory review process, the Government allocated $150 million over five years to establish the Major Projects Management Office (MPMO) within Natural Resources Canada (NRCan) and to increase the scientific and technical capacity of key regulatory departments and agencies to improve the efficiency and effectiveness of the regulatory system for major resource projects.

The MPMO was created to provide a single point of entry into the federal regulatory system for all stakeholders and to provide overarching management of the federal regulatory process for major natural resource projects. New capacity funding provided through this initiative is ensuring that key regulatory departments and agencies are positioned to respond to the regulatory demands of major resource projects and better meet any legal responsibilities for Aboriginal Crown consultation associated with their regulatory decisions.

The purpose of the horizontal initiative is to provide the oversight and capacity needed to address issues affecting the performance of the federal regulatory system. In short, it is laying the foundation for more predictable and timely regulatory processes that will improve the competitiveness of Canada's resource industries while ensuring careful consideration of environmental standards and Aboriginal consultation obligations.

Shared Outcome(s):

Among the more tangible improvements resulting from this initiative is the timeliness and predictability of the regulatory process. The process for environmental review and permitting of major resource projects has been reduced from upwards of four years to an average of about two years.
Other important outcomes from this proposal include:

  • A more accountable, predictable and timely regulatory review process that will facilitate investment and planning decisions and improve the competitiveness of Canada's resources industries;
  • High-quality assessments of the potential environmental and social effects of resource development so that federal decisions in relation to projects protect the environment; and,
  • The fulfillment of Aboriginal consultation responsibilities in a more consistent, adequate and meaningful manner.

Governance Structure(s):

The Cabinet Directive on Improving the Performance of the Regulatory System for Major Resource Projects established a new governance framework for federal government departments and agencies to facilitate the effective, coordinated, and concurrent discharge of their statutory duties, functions and obligations related to the regulation of major resource projects. It encourages federal government departments to work together to identify areas where the consistency, efficiency and effectiveness of the federal regulatory system can be improved and to develop and implement system improvements. These activities are intended to improve the accountability, transparency, timeliness and predictability of the federal regulatory system for major natural resource projects.

The Minister of Natural Resources is the lead Minister for the Initiative. In collaboration with his counterparts in other regulatory departments, the Minister of Natural Resources reports biannually to Cabinet on progress made towards achieving the objectives of the initiative, and reports annually to Parliament and the public through NRCan's annual reporting requirements.

A Major Projects Deputy Ministers' Committee was created to serve as the governance body for the implementation of the initiative. This Committee provides direction for the resolution of project-specific issues and oversee the application of the Cabinet Directive. Membership on this committee includes the Deputy Ministers of NRCan (Chair), Fisheries and Oceans Canada, Environment Canada, Aboriginal Affairs and Northern Development Canada, Justice Canada, as well as the Associate Deputy Minister of Transport Canada, the President of the Canadian Environmental Assessment Agency, the President of the Canadian Nuclear Safety Commission, the Chair of the National Energy Board, the Deputy Secretary of the Privy Council Office and the President of the Canadian Northern Economic Development Agency.

The MPMO was established to provide overarching management of the federal regulatory system for major resource projects. It achieves this by working with the federal regulatory departments / agencies to identify areas where the consistency, efficiency and effectiveness of the federal regulatory process can be improved and to implement change. The MPMO also provides support to the Major Projects Deputy Ministers' Committee, through the provision of data, analysis and other information.

To ensure effective communication with federal regulatory departments on key issues and to facilitate collaboration and cooperation, interdepartmental working groups have been established at the ADM, DG and working levels.

Over the course of 2011-12, the MPMO worked in close collaboration with federal regulatory departments and agencies to advance the development of a suite of legislative, regulatory and policy measures aimed at delivering predictable and timely project reviews; reduced duplication, strengthened environmental protection and enhanced Aboriginal consultations for major project reviews;

These measures were introduced through Budget 2012 as part of the Government’s plan for Responsible Resource Development that seeks to fundamentally modernize Canada’s regulatory system for major projects.

The MPMO is overseeing the federal regulatory review process for more than 70 major natural resource projects representing over $150 billion in potential new capital investment in communities across Canada. NRCan/MPMO also chaired monthly meetings of the Major Projects Deputy Ministers' Committee and supporting ADM and DG Committees to ensure timely resolution of project-related issues, and to advance new policies, procedures and analysis to further improve the performance of the federal regulatory system for major resource projects.

All MPMO projects undergoing a federal regulatory review are on track to have Project Agreements (PAs) signed by Deputy Heads.

The MPMO maintains a robust performance management system to ensure project reviews meet target timelines.

This includes:

  • Project Agreements signed by federal Deputy Heads that contain milestones and target timelines for each project review;
  • Publicly tracking/monitoring milestones through the MPMO Tracker website;
  • Weekly and monthly reporting to Deputy Heads to ensure issues are effectively managed;

The whole-of-government approach to Aboriginal consultation under the MPMO Initiative continues to be strengthened and applied.

The federal-provincial-territorial ADMs’ Regulatory Reform Working Group, co-chaired by MPMO, delivered on key commitments made through the 2011 Annual Energy and Mines Ministers Conference. Through this mechanism, several pilot projects are being advanced to improve alignment of federal-provincial-territorial regulatory systems with the goal of putting in place a ‘one project, one review’ approach; and,

The MPMO also worked bilaterally with provinces to improve alignment of regulatory processes. To strengthen northern regulatory regimes, the MPMO supported Aboriginal Affairs and Northern Development Canada in the development of a suite of policy proposals to align policy approaches both North and South of the 60th parallel. The MPMO also supported the Northern Projects Management Office to improve the consistency of project management approaches both North and South of 60.

A horizontal evaluation of the MPMO Initiative was completed as a means of assessing and ensuring results-based performance across the Government of Canada and supporting continuous improvement of the federal regulatory system. Findings pointed to a clear on-going need for the Initiative as well as the central coordination function performed by the MPMO.

AANDC regional offices capacity enhancement was achieved, which enabled them to meet their environmental assessment, Aboriginal consultation and regulatory responsibilities on MPMO project files.

Provided funding support to regulatory boards in the Northwest Territories to allow them to better meet their Aboriginal consultation, regulatory permitting and environmental assessment responsibilities with respect to major resource projects.

Supported the plan for Responsible Resource Development in the initial and implementation phases. AANDC LEMB as the Responsible Authority (RA) for the Northern Gateway Pipeline Project and pursuant to the Project Agreement has met the established timelines and service standards.

Regional Environmental Operations and Headquarters staff worked with the Aboriginal Consultation and Accommodation Unit on project files in order to support project and issues management.

The BC Region received $170K to build awareness with respect to resource development and the regulatory process in relation to areas with high resource development activity. Approximately, $40K went to the Canadian Environmental Assessment Agency to support the Aboriginal Funding Envelope in relation to Northern Gateway.

TC's Aboriginal Consultation Unit assisted in implementing Aboriginal consultation for MPMO projects. TC has also developed Aboriginal Consultation and Accommodation Guidelines, tools and training materials; and

TC liaises with the MPMO and other government departments in implementing a whole-of-government approach for Aboriginal Consultation.
