Impact of changes to your project
Before the start of the compliance period, as defined in section 127.48 of the Income Tax Act, certain situations will require that a revised clean hydrogen project plan be submitted to NRCan. If NRCan determines that there has been a material change to the project’s design, or if you identify material changes to your project, as described below, you are required to submit a revised project plan on NRCan’s portal.
You will be required to submit a revised project plan to NRCan if any of the following conditions occur before the first day of the compliance period of the project:
NRCan determines that there has been a material change to the project design (see the Validation and Verification Guidance Document — Clean Hydrogen Investment ITC for details) and directs you to file a revised project plan.
You reasonably expect that there will be an increase, compared to the most recent project plan, of more than 0.5 kilograms of carbon dioxide equivalent per kilogram of hydrogen to be produced by the project.
You change the project’s eligible pathway.
You do not file the final detailed engineering designs with NRCan.
Any eligible power purchase agreement referenced in your most recent clean hydrogen project plan has not been finalized and executed so as to become legally binding or has been materially modified or terminated.
You have disposed of any environmental attributes associated with the power purchase agreement.
A revised clean hydrogen project plan must be submitted within 180 days from the occurrence of any of the events described above. To submit a revised project plan, log in to NRCan’s portal, and start a new application process. To link the new submission to the file, in the designated space, please indicate that this is a revised project plan, provide the project submission code of your related project plan(s) and briefly detail the changes made to the clean hydrogen project plan.
Following the submission of a revised project plan, NRCan will issue a confirmation of the revised project plan to you and to CRA if your project is determined to be a qualified clean hydrogen project.
Additionally, it is your responsibility to inform NRCan of any change in project ownership.
