Reporting an Incident

There are legal provisions in the Explosives Regulations, 2013 (ER, 2013) that require reporting of incidents and accidents to the Explosives Regulatory Division. The following form can be used to report an incident:

Explosives (including Fireworks)

Fire and Incidents (ER, 2013 - S. 167)

• A holder of a licence, permit or certificate must immediately inform the local fire department of any fire that involves an explosive under their control.
• A holder of a licence, permit or certificate must inform an inspector as soon as the circumstances permit of any of the following incidents that involves an explosive under their control:
  • the theft, attempted theft of loss of an explosive
  • a fire, spill or accidental explosion
  • an injury or death, or
  • any accidental property damage.

Transporting

Accidents and Incidents (ER, 2013 - S. 201)

• The driver of a vehicle that contains explosives and is involved in an accident or incident that is likely to delay the delivery of the explosives must, as soon as the circumstances permit, notify the police and the carrier of the accident or incident and the delay.

Ammonium Nitrate

Theft or Tampering (ER, 2013 - S. 488)

• If any theft or attempted theft of, or tampering with, ammonium nitrate is discovered:
  • the local police force must be informed immediately, and
  • a written report of the incident must be submitted to the Chief Inspector of Explosives within 24 hours after the discovery.

No Sale (ER, 2013 - S. 489)

• A sale of ammonium nitrate must be refused if:
  • the quantity requested is not proportional to the buyer’s needs, or
  • the component seller or their employee has reasonable grounds to suspect that the ammonium nitrate will be used for a criminal purpose.
• Every refusal to sell ammonium nitrate must, within 24 hours after the refusal, be reported to the Chief Inspector of Explosives and to the local police force.

Other Restricted Components

Theft or Tampering (ER, 2013 - S. 471)

• If any theft or attempted theft of, or tampering with, a restricted component is discovered:
  • the local police force must be informed immediately
  • the Chief Inspector of Explosives must be informed within 24 hours after the discovery, and
  • a written report of the incident must be submitted to the Chief Inspector of Explosives as soon as the circumstances permit

No Sale (ER, 2013 - S. 472)

• The sale of a restricted component must be refused if the seller has reasonable grounds to suspect that the component will be used for a criminal purpose.
• Every refusal to sell a restricted component must, within 24 hours after the refusal, be reported to the Chief Inspector of Explosives and to the local police force.
